legal matters, and it is not because they are emotional.
As you will see, the court &
tribunal forms, rules and laws involved can be very
daunting to say the least. As a result, we find that
most do not utilize the forms and rules properly. And
if those fundamental elements are not done properly,
there can be problems with your case later on.
We find that most need help with
both procedural and substantive matters that can be
common hurdles to overcome in Small Claims Court, Landlord
& Tenant Court, Traffic & Provincial Offences
court and the Administrative & Appeal Tribunals.
For example, the Small Claims
Court is a branch of the Superior Court of Justice and
has its own set of Rules deriving from the Courts of
Justice Act; similarly, the Landlord-Tenant Tribunal
is governed by several legislations, Tenant Protection
Act and Statutory Powers and Procedures Act and also
has its own particular set of regulations.
In the Provincial Courts, where
Traffic Tickets and various Offences are dealt with,
the constitution of the court is governed by, among
other things, the Provincial Offences Act.
In the other tribunals (such as
the Human Rights, Employment and Licence Appeal Tribunal
and so on) you will have to grapple with different laws
and rules governing them, so it could be a daunting
task.
The point is all persons, represented
or not are expected to be aware of all the rules and
should reasonably be able understand them when coming
to a court or tribunal.
When the government created the
rules and regulations to try and simplify procedures
so that the average person can file (without legal representation
hence saving on legal fees) in small claims or landlord-tenant
tribunal when they are aggrieved in some way, we dont
think they ever anticipated the complex matters that
would be brought in them.
As a result, there is an obvious
need by the general public to hire affordable representation
(hence support) such as an experienced Paralegal
& Court Agent to tackle the small issues and
help unwind the complex web of all the rules.
The Small Claims Court and Landlord-Tenant
Tribunal have a maximum amount of $25,000.00 one can
claim for. And we anticipate that also will be increased
to a higher amount as the cost of business increases.
The Judges and Adjudicators have
limits, and cannot help you if you are un-represented;
to the point that they actually become your counsel.
Generally, people dont have
time to un-tangle the rules to make them workable for
them. Moreover, they dont know where to turn to
for affordable help.
The representation by someone
(other than a Lawyer) which the courts refer to as a
Court Agent is permitted in all of courts
& tribunals mentioned here.
